Answered: NEC3 TSC: Can an Employer insist on removal of a subcontractor under TSC if the subcontractor is not performing?

The short answer is 'No' as there is no provision in the contract that allows them to do this.

The danger, as a main Contractor, is that the Subcontractor is so underperforming as to result in you, as the main Contractor, being in substantial default, whereupon the Employer can start termination proceedings against you !
